British Columbia (1997) and Tsilhqot\u2019in Nation v. British Columbia (2014)\u2014Aboriginal title predates and burdens the Crown\u2019s radical title.<\/div>\n<div dir=\"auto\">Fee-simple ownership exists only because the Crown granted it, and the Crown\u2019s title itself is subject to Aboriginal title.<\/div>\n<div dir=\"auto\">Aboriginal title is a constitutionally protected, sui generis property right under section 35 of the Constitution Act, 1982, whereas fee simple is a statutory creation that changes hands freely but rests upon the deeper Indigenous interest in land.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">To assert\u2014as Ms. Sharma did\u2014that Aboriginal title cannot affect or \u201cdisplace\u201d fee simple turns the constitutional order upside down.<\/div>\n<div dir=\"auto\">Mr. Rustad went further, framing recognition of Aboriginal title as a \u201cthreat\u201d to homeowners, a claim that weaponizes public misunderstanding for political gain.<\/div>\n<div dir=\"auto\">If any other quoted officials echoed this phrasing, they too repeated the same error.<\/div>\n<div dir=\"auto\">None of these statements withstand basic legal scrutiny.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The responsibility, however, does not end with politicians.<\/div>\n<div dir=\"auto\">Journalists covering constitutional issues have a duty to verify accuracy before publication.<\/div>\n<div dir=\"auto\">By reproducing these claims without analysis, Mr. Shaw\u2019s report inadvertently legitimized a false hierarchy of property rights, implying that reconciliation endangers private ownership when the opposite is true.<\/div>\n<div dir=\"auto\">In law, fee simple depends upon\u2014and does not supersede\u2014Aboriginal title.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">British Columbia\u2019s academic institutions\u2014particularly SFU and UBC, both leaders in Indigenous legal education\u2014should treat this episode as a cautionary example of how public discourse can distort constitutional reality when language is used carelessly.<\/div>\n<div dir=\"auto\">Precision matters.<\/div>\n<div dir=\"auto\">Words like \u201cdisplace\u201d carry legal consequences; used incorrectly, they undermine both reconciliation and public trust in the rule of law.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Aboriginal title is not subordinate to private property.
