{"id":66637,"date":"2025-04-29T11:14:50","date_gmt":"2025-04-29T18:14:50","guid":{"rendered":"https:\/\/energi.media\/?p=66637"},"modified":"2025-04-29T11:14:50","modified_gmt":"2025-04-29T18:14:50","slug":"district-court-judge-upholds-the-hagues-fossil-fuel-advertising-ban-sets-example-for-canada","status":"publish","type":"post","link":"https:\/\/energi.media\/news\/district-court-judge-upholds-the-hagues-fossil-fuel-advertising-ban-sets-example-for-canada\/","title":{"rendered":"District court judge upholds The Hague\u2019s fossil fuel advertising ban, sets example for Canada"},"content":{"rendered":"<p><em>This article was published by <a href=\"https:\/\/www.theenergymix.com\/district-court-judge-upholds-the-hagues-fossil-fuel-advertising-ban-sets-example-for-canada\/\" target=\"_blank\" rel=\"noopener\">The Energy Mix<\/a> on April 28, 2025.<\/em><\/p>\n<p><em><strong>By Gaye Taylor<\/strong><\/em><\/p>\n<p>Climate and public health advocates around the world are celebrating\u2014and urging municipalities everywhere to take note\u2014after a Dutch judge tossed out a tourist industry challenge to The Hague\u2019s municipal ban on fossil fuel advertising, a global first when it became law last September.<\/p>\n<p>In a precedent-setting ruling that marks the first time a court has vetted a municipal fossil-fuel ad ban, a judge at the District Court of The Hague confirmed that local governments \u201ccan lawfully take necessary climate action, even where it might be contrary to economic interests of polluting companies,\u201d Climate Action Against Disinformation\u00a0<a href=\"https:\/\/caad.info\/analysis\/briefings\/court-rules-judge-upholds-fossil-fuel-ad-ban-tosses-industry-argument-against-the-hague\/\">said<\/a>\u00a0in a release [<em>pdf<\/em>].<\/p>\n<p>In a virtual media briefing, lawyer Tjarda van der Vijver, director of Advocates for the Future, which supported The Hague in its defence of its ban, laid out the case against the measure as it was put forward bythe plaintiffs: the Dutch Trade Association of Travel Companies and Germany-based travel agency titan TUI.<\/p>\n<p>Arguing that the ban was fundamentally \u201cunlawful,\u201d the plaintiffs claimed it was \u201cineffective\u201d as well as \u201cunclear and disproportionate.\u201d They further argued the ban \u201cdid not concern a specific local public interest\u201d and that the municipality of The Hague was therefore exceeding its authority. They maintained the ban also violates EU free speech laws.<\/p>\n<p>Although the ban covers ads pertaining to all fossil fuel products and services, including natural gas contracts and even hybrid cars, the tourism heavyweights focused on the harms such a ban would pose to their primary revenue streams: airline tickets and cruise ship packages.<\/p>\n<p>Dismissing every argument put forward by the travel industry representatives, the district court judge \u201cobserved that the municipality has a wide margin of appreciation [i.e. discretion] to enact laws with a view to protect local public interest,\u201d van der Vijver told the briefing.<\/p>\n<p>\u201cThe court is basically saying, \u2018wait a minute, if this is a democratically legitimized measure trying to address public interest, who am I as a judge to intervene too much?\u2019\u201d<\/p>\n<p>Rejecting the travel industry\u2019s claim that the ban did not involve the local public interest, the court said the measure made a clear contribution to local public health and climate policy objectives.<\/p>\n<p>Van der Vijver also noted the extent to which the court \u201cexplicitly and sometimes more implicitly showed deference\u201d to the scientific evidence The Hague marshalled in defence of the advertising ban. The court also dismissed the claim that the ban would be \u201cineffective\u201d in helping to cut climate emissions.<\/p>\n<p>\u201c\u2018Every little bit helps,\u2019 was what the Dutch court said, which is a very clear statement that this is all about the contribution to the fight against climate change,\u201d noted the lawyer.<\/p>\n<p>In what van der Vijver described as \u201ca very clear red thread running through the judgment,\u201d the court acknowledged that the ban might well \u201clead to a restriction of the free movement of goods and services,\u201d but that such restrictions can be justified under EU laws protecting public health and the environment.<\/p>\n<p>\u201cIt is not up to the municipality to refrain from taking measures to promote the health of its residents in order to strengthen the future (financial) position of travel providers,\u201d the judge wrote.<\/p>\n<p>\u201cThis ruling is a breakthrough moment. It shows that municipalities can stand up to the big polluters and take real action to protect their residents. If The Hague can ban fossil fuel advertising to safeguard health and the climate, so should Canadian cities,\u201d emergency physician Dr. Joe Vipond, a past president of the Canadian Association of Physicians for the Environment (CAPE) told\u00a0<em>The Energy Mix<\/em>.<\/p>\n<p>\u201cCanadian municipalities now have a clear path to follow: Prioritize people over profits, and start clearing fossil fuel propaganda from our streets,\u201d Vipond added.<br \/>\n\u201cThis ruling is a huge victory for public health,\u201d added Dr. Leah Temper, director for CAPE\u2019s Fossil Fuel Ads Make Us Sick campaign.<\/p>\n<p>\u201cThe Hague\u2019s leadership shows that municipalities have the power and the responsibility to break the toxic grip of fossil fuel advertising,\u201d Temper said. \u201cCanadian cities must act now to protect our health, our air, and our future from the fossil fuel industry\u2019s disinformation.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\"><p>This article was published by The Energy Mix on April 28, 2025.
